Understanding International Family Law in Australia

As a specialized discipline of family law, there are countless legislations concerning international family rights in Australia. We rounded up the top three legislations you will most often encounter when dealing with international family law or related cases.

Hague Convention on the Civil Aspects of International Child Abduction

When talking about international family law, it's impossible not to mention the Hague Convention. The Hague Convention on the Civil Aspects of International Child Abduction was created in 1980 and administered by the Australian Central Authority in the Attorney-General's Department. The 1980 Hague Convention is the gathering of 101 countries addressing the state of international child abduction. The participating states signed a document agreeing to collaborate with the Australian government to seek and return the abducted child to their home country. While this convention is the most referenced in international family law, there are many core Hague conventions addressing other issues concerning family law. Other relevant core Hague conventions are the 1970 Divorce Convention, the 1996 Child Protection Convention, and the 2007 Child Support Convention.

The Family Law Act 1975

Another relevant legislation concerning international family law is the Family Law Act of 1975. The law allowing international couples to file a divorce in Australia without getting married in the country is stipulated under section 39 of the Family Law Act (1975).
This law also covers the grounds of parental arrangement and child custody. One of the most prominent sections addressing this is section 60CC, in which the law specifies how both parents must take into account the child's best interest.
This legislation also covers other aspects of international family law, such as the division of international conjugal properties, child maintenance, and cohabitation

Child Support (Assessment) Act 1989

The Child Support (Assessment) Act of 1989 is another vital legislation to international family law. Under this act, determining the practical division of child support between each parent will depend on several factors, such as each parent's individual income, required monthly expenses, and the amount of time the child will spend living with each parent.
Services Australia primarily oversees the administrative child custody process. However, there are cases when the child custody case has to go through court, such as in child custody appeals cases.
